1. Overview

LevelUp Lore ("the Service") is an experimental educational platform that uses artificial intelligence to transform lecture material into interactive RPG-style games. By using the Service, you agree to these Terms & Conditions.

2. Experimental Nature

The Service is experimental. The quality, accuracy, and completeness of AI-generated game content may vary. Games are intended as supplementary study aids and should not be relied upon as the sole source of educational material. The owner and operator of LevelUp Lore makes no warranties regarding the accuracy of generated content.

3. No Liability for Generated Content

The operator of LevelUp Lore is not responsible for the accuracy, completeness, or suitability of any content generated by the AI system. All generated game content, including text, images, diagrams, and educational material, is produced automatically and may contain errors or omissions. Users are encouraged to verify information with their original course materials.

4. Pricing and Payment

• Single Game: $5 USD per game generation (one-time payment)
• Monthly Subscription: $30 USD per month for up to 7 game generations per billing cycle

All payments are processed securely through Stripe. Prices are in US Dollars (USD).

4a. Price Changes

We reserve the right to change our pricing at any time. The following protections apply:

• Single-game purchases are charged at the price displayed at the time of purchase. Once paid, the price cannot change for that purchase.
• Subscribers will be notified by email at least 7 days before any price change takes effect. The new price will only apply to billing cycles that begin after the notice period.
• You may cancel your subscription at any time prior to the next billing cycle if you do not agree with a new price. Cancellation takes effect at the end of the current billing cycle, and you retain access to any remaining generation credits until then.
• Continuing to use the subscription after a price change takes effect constitutes acceptance of the new price.

5. File Size Limits

Lecture uploads are limited to 10 MB per file. For longer lectures, users should split the material into separate sections and generate individual games for each section. This ensures optimal game quality and focused content.

6. Refund Policy

In accordance with Australian Consumer Law:

• If a game fails to generate due to a technical error, a full automatic refund will be issued for single-game purchases.
• For subscribers, a generation credit will be restored to your monthly allocation if generation fails.
• Refunds are processed automatically — no action is required from the user.
• Refunds are not available for successfully generated games that the user is dissatisfied with, as the AI generation process has been completed as described.

7. Subscription Cancellation

Monthly subscriptions can be cancelled at any time through the account management portal. Upon cancellation:

• You retain access to all remaining generation credits until the end of your current billing cycle.
• All previously generated games remain in your account permanently.
• No further charges will be made after cancellation takes effect.

8. Data Privacy

• Uploaded lecture files are stored privately and are only accessible by the uploading user.
• Generated games are stored privately in each user's account.
• Lecture content is processed by AI services (Anthropic Claude, Fal AI) for game generation only and is not stored by these services beyond the generation process.
• We do not share, sell, or distribute user data or uploaded content to third parties.

9. Intellectual Property

Users retain ownership of their uploaded lecture material. Generated game content is provided under a personal-use licence. Users may not redistribute, sell, or sublicence generated games.

10. Service Availability

As an experimental service, LevelUp Lore may experience downtime, changes, or discontinuation. While we strive for reliability, no uptime guarantees are made. Users will be notified in advance of any planned service discontinuation.

11. Account Security

Users are responsible for maintaining the security of their account credentials. The Service uses industry-standard authentication and encryption.

12. Australian Consumer Law

These terms do not exclude, restrict, or modify any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Where our goods or services come with guarantees that cannot be excluded under Australian Consumer Law, our liability for failure to comply with the guarantee is limited to the resupply of the service or a refund.

13. Changes to Terms

We may update these Terms & Conditions from time to time. Users will be notified of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
